Terms of Service
These terms govern access to Fonte websites, early access, and product experiences.
These Terms of Service ("Terms") are an agreement between you and Fonte Inc. and its affiliates ("Fonte", "we", "us", or "our"). By accessing Fonte websites, requesting early access, creating an account, or using Fonte, you agree to these Terms.
If you use Fonte on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms. In that case, "you" means that organization.
Early access
Fonte may offer screened early access before public availability. Early access does not guarantee acceptance, product availability, continued access, pricing, support level, or any specific feature.
We may change, limit, suspend, or discontinue early access at any time. We may also contact you to understand your use case before granting access.
Accounts and access
You are responsible for the accuracy of information you provide and for activity under your account. You must keep credentials secure and notify us if you suspect unauthorized access.
You may not share access in a way that bypasses Fonte permissions, security controls, account limits, or workspace boundaries.
Acceptable use
You may not use Fonte to:
- violate laws or the rights of others;
- send unlawful, deceptive, or unauthorized messages;
- upload malware or interfere with Fonte systems;
- attempt to access systems, data, accounts, or workspaces without authorization;
- reverse engineer Fonte except where the law prohibits that restriction;
- submit data you do not have the right to use with Fonte.
Customer data and integrations
You retain ownership of data you submit to Fonte or make available through connected services. You grant Fonte permission to process that data as needed to provide, secure, support, and improve the service.
You are responsible for configuring your integrations, obtaining required rights and consents, and ensuring that any data, contacts, messages, checkout events, revenue events, or platform signals you send through Fonte may lawfully be used for that purpose.
Third-party services you connect to Fonte are governed by their own terms and policies. Fonte is not responsible for third-party services outside our control.
Messaging and compliance
If Fonte makes messaging or follow-up features available to you, you are responsible for the content of your messages, the audiences you choose, and compliance with applicable consent, unsubscribe, anti-spam, advertising, and privacy rules.
Fonte may refuse, suspend, or limit sending behavior that appears abusive, unlawful, harmful, or inconsistent with platform requirements.
Fees
Some Fonte features may be free, paid, usage-based, or offered through a separate order form. If fees apply, the applicable pricing, billing terms, and taxes will be described in the relevant checkout, invoice, order form, or written agreement.
Intellectual property
Fonte and its software, designs, documentation, trademarks, and other materials are owned by Fonte or its licensors. Except for rights expressly granted to you, we reserve all rights in Fonte.
If you provide feedback, suggestions, or ideas, we may use them without restriction or compensation to you.
Confidentiality
During early access or private product discussions, either party may receive non-public information from the other. The receiving party must use reasonable care to protect that information and use it only for the purpose for which it was shared.
Disclaimers
Fonte is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
Attribution, revenue, messaging, and destination-platform reporting can depend on your implementation, connected providers, browser behavior, consent state, platform rules, and data quality. Fonte does not guarantee that every source, event, customer, payment, message, or platform signal will be captured, matched, accepted, or attributed.
Limitation of liability
To the fullest extent permitted by law, Fonte will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost goodwill, or business interruption.
To the fullest extent permitted by law, Fonte's total liability for any claim relating to the service or these Terms will not exceed the amount you paid Fonte for the service in the three months before the event giving rise to the claim, or one hundred US dollars if you have not paid Fonte.
Suspension and termination
We may suspend or terminate access if you violate these Terms, create security or legal risk, fail to pay amounts due, or use Fonte in a way that may harm Fonte, users, third-party services, or others.
You may stop using Fonte at any time. Some provisions, including payment obligations, confidentiality, intellectual property, disclaimers, liability limits, and dispute-related terms, survive termination.
Changes
We may update these Terms as Fonte changes. If we make material changes, we will update the date above and provide additional notice when appropriate. Continued use after changes become effective means you accept the updated Terms.
